When you download, access and use the services contained in this website or the MayPera application, you acknowledge and agree that you have carefully read, understood, accepted and agreed to all terms and conditions and other documents related thereto, which is the agreement between you and MayPera.
We reserve the right to change, add, reduce, replace, adjust this Term of Use (in part or in whole), and any changes we make to the terms and conditions from time to time will be listed on our website (https://www.maypera.ph/) or Maypera Application.
For that you are required to read the Term of Use from time to time that we provide on our website above or through Maypera Application. These terms and conditions apply to your use of our services on the website/mobile application wherever you are, whether within the Philippines or er countries.
This contract describes the general terms and conditions applicable to the use of the services offered by LUCKY SHELL FINTECH LENDING, INC., (hereinafter "MayPera) within the site (https://www.maypera.ph/) and MayPera application, that derive from all those domains of which MayPera is owner and/or its own or third party mobile application(s) and, in general, all its present or future technological developments (altogether with the Web Pages and the Apps), will be referred to in the Platforms and in these General Terms and Conditions, indistinctly as MayPera. Any person wishing to access or use the Platforms or services may do so subject to the General Terms and Conditions, together with all other policies and principles governing MayPera, which are incorporated herein by reference.
ANY PERSON WHO DOES NOT ACCEPT THESE GENERAL TERMS AND CONDITIONS, WHICH ARE MANDATORY AND BINDING, MUST REFRAIN FROM USING THE PLATFORMS AND/OR SERVICES.
The User must read, understand and accept all the conditions established in the General Terms and Conditions and in the Privacy Notice as well as in the other documents incorporated to them by reference, prior to his registration as a MayPera User.
The Service is available only to persons with legal capacity to contract. Persons who do not possess this characteristic, minors, or MayPera users who have been temporarily suspended or expressly disqualified may not use the Services. If you register as a user in the name of a company, you must have the ability to contract in the name of that entity and bind it to the terms of this Agreement and comply with the provisions of Philippine law.
It is mandatory to complete the registration form in all its fields with valid personal data in order to be able to use the services provided by MayPera. The User must complete it with his/her personal information in an exact, precise and true way ("Personal Data") and assumes the commitment to update the Personal Data as necessary. MayPera will be able to use diverse means to identify its Users as well as to request electronic Means of Authentication and Credit Reports, but MayPera is NOT responsible for the certainty of the Personal Data provided by its Users. The Users guarantee and are responsible, in any case, for the truthfulness, accuracy, validity and authenticity of the Personal Data entered. MayPera reserves the right to request some additional proof and/or data in order to verify the Personal Data, as well as to suspend temporarily or definitively those Users whose data have not been able to be confirmed.
The user agrees to use electronic means of authentication. It is mutually agreed that the user may consent to this contract and also to access the services provided by LUCKY SHELL FINTECH LENDING, INC. by electronic means such as PIN codes. The user authorizes LUCKY SHELL FINTECH LENDING, INC. to explicitly request a credit report for the purpose of investigating credit behavior at the credit information company it deems appropriate. The user is aware of the nature and scope of the information that will be requested, of the use that will be made of it, and of the periodic inquiries that will be made of the credit record. The user agrees that this authorization is valid for 3 years from today, if necessary, as long as the legal relationship remains intact. The user agrees that this document is the property of LUCKY SHELL FINTECH LENDING, INC. .
The User will access his/her personal account ("Account") by entering his/her chosen key and password ("Security Key"). The User agrees to maintain the confidentiality of his/her Security Key. The Account is personal, unique and non-transferable, and it is prohibited that the same User registers or possesses more than one Account. In case MayPera detects different Accounts that contain coincident or related data, it will be able to cancel, suspend or disable them.
The User will be responsible for all the operations carried out in his Account, since the access to the same is restricted to the entry and use of the Security Key, of exclusive knowledge of the User. The User undertakes to immediately notify MayPera, by appropriate and reliable means, of any unauthorized use of his account, as well as of any access to his account by unauthorized third parties. It is expressly forbidden to sell, assign or transfer accounts (including credits and qualifications) under any name.
MayPera reserves the right to reject any registration request or to cancel a previously accepted registration, without being obliged to communicate or explain the reasons for its decision and without this generating any compensation or indemnification.
However, if the application is rejected for the user's reasons, MayPera will be able to show them other options to adapt to their ability to pay, with the aim of facilitating access to credit, which does not imply any obligation on the part of the applicant to accept these options.
The user agrees to use electronic means of authentication. MayPera may modify the General Terms and Conditions at any time by publishing the modified terms on the Platforms. All modified terms will come into force 10 days after their publication. Within 5 days after the publication of the modifications introduced, the User must communicate by e-mail if he/she does not accept them; in that case the contractual link will be dissolved and he/she will be disqualified as a User as long as he/she has no outstanding debts. Upon expiry of this period, the User shall be deemed to have accepted the new terms and the contract shall continue to bind both parties.
In order to use the Services offered by Rápikrédito, Users must provide certain personal data. Your personal information is processed and stored on servers that maintain high standards of security and protection, both physical and technological. For more information on the privacy of Personal Data and cases in which personal information will be disclosed, you can consult our Privacy Notice.
No action or use of equipment, software or other means to interfere with the activities and operations of MayPera and its databases will be permitted. Any act, attempt or activity that violates intellectual property laws and the prohibitions set forth in this contract will subject the person responsible to the relevant legal liabilities and sanctions foreseen in this agreement, as well as to the compensation of the damages caused.
Without prejudice to other measures, MayPera may warn, temporarily or permanently deactivate a User's account, impose sanctions that adversely affect the User's reputation, take such action as it deems appropriate and/or suspend the provision of its services if: (a) it violates any law, or any provision of the General Terms and Conditions and other MayPera policies; (b) it violates its commitments as a User; ( c) an act of fraud, as determined by MayPera, occurs; (d) the identity of the user cannot be verified or any information provided by the user is incorrect; (e) MayPera believes that public statements or other conduct may result in liability for the user who posted them.
MayPera recommends being cautious and having common sense when dealing with other users. Users must also keep in mind the risks of contracting with minors or people using false identities.
If one or more users or any third party initiates any type of claim or legal action against another user, each user involved in said claim or action releases MayPera and its directors, managers, employees, agents, operators, representatives and attorneys-in-fact from all liability.
MayPera is not responsible for any damage or loss caused to the user as a result of a failure of the system, server or Internet. MayPera is also not responsible for any virus that may infect the user's equipment as a result of accessing, using or examining its platform or as a result of any transmission of data, files, images, text or audio, and any other information sent using digital means. The user cannot attribute any responsibility or claim payment for lost profits due to technical difficulties or failures on the system or on the Internet. MayPera does not guarantee continuous or uninterrupted access to and use of its platform. The system may eventually become unavailable due to technical difficulties or failures on the Internet, or due to any other circumstances beyond MayPera's control; in such case, we will re-establish it as soon as possible, but without any liability. MayPera will not be liable for any errors or omissions in its platform.
Due to the fact that the verification of the identity of Users on the Internet is difficult, MayPera cannot confirm the identity of each User. Therefore, the User has an information system of Users that is periodically updated based on data related to their activity on the Platforms and comments entered by Users according to the operations they have performed. This information system will also include a section where Users will be able to make comments and replies to the ratings received and access them. Such comments will be included under the sole responsibility of the Users who issue them.
Since the identity verifications, comments and replies are made by the Users and therefore are personal data, they will be included under the exclusive responsibility of the Users who issue them.
The content related to the MayPera Services and the programs, databases, networks, files that allow users to access and use their accounts are the property of MayPera and are therefore protected by international copyrights, trademarks, patents, models and industrial designs. Improper use and reproduction, in whole or in part, of such content is prohibited unless expressly authorized in writing by MayPera.
User will indemnify and hold MayPera, its subsidiaries, control and/or regulatory companies, directors, administrators, representatives and employees free from any claim or demand, including a reasonable amount of attorneys' fees, made by any other User or third party due to its activities on the Platform or for violation of the General Terms and Conditions and other policies understood to be incorporated into this Agreement or for violation of any law or the rights of a third party .
This Agreement shall be governed in all respects by the laws in force in the Philippines, particularly with respect to data information, electronic contracts and electronic commerce. Any dispute arising out of this Agreement, its existence, validity, interpretation, scope or performance shall be submitted to the applicable law and the competent courts.
For the interpretation, performance and enforcement of this contract, the parties expressly submit to the jurisdiction of the Philippine courts and waive any other jurisdiction that may correspond by virtue of their present or future domicile.

For matters not covered in these Terms and Conditions, Customer agrees to comply with the applicable laws of the Philippines.
With respect to the interpretation and enforcement of these terms and conditions, the user agrees to submit to the jurisdiction of the Philippine courts, expressly waiving any other jurisdiction that may correspond by virtue of its present or future domicile.
Failure to meet your obligations may result in late fees and interest.
Loan that exceeds your ability to repay can affect your credit records.
